Applicability of the principle of timely assertion to salary claims pending subsequent executive declaration
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted the plaintiff's leave to appeal, thereby overturning the higher administrative court’s decision that had refused to permit a revision. The dispute concerned a civil service claim for the supplementary payment ("Sonderzahlung") for 2008, where the lower court had likely dismissed the claim based on procedural or substantive grounds related to the timing of the assertion. The BVerwG found the appeal well-founded because the plaintiff demonstrated the question of fundamental legal significance under § 132 Abs. 2 Nr. 1 VwGO, specifically whether the principle of timely assertion applies to salary claims whose legal basis exists but whose specific amount is determined only by a subsequent executive declaration. The case was remanded for the revision instance, with the dispute value provisionally set at €372.
