Disqualification of pensions in disciplinary proceedings delayed beyond reasonable time: Union law and ECHR constraints
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) overturned the lower court's refusal to grant leave for revision and admitted the appeal, ruling in favor of the defendant in this procedural dispute concerning a public servant's disciplinary proceedings. The core issue is whether the removal of pension rights can be imposed as a disciplinary sanction when the disciplinary procedure suffered from excessive delay, and what constraints the EU law and the European Convention on Human Rights impose on such sanctions in this context. The decisive legal basis is the requirement of fundamental legal significance under § 69 BDG in conjunction with § 132(2) No. 1 VwGO, which necessitates clarification of these specific legal questions to justify the admission of the revision.
