Costs of jurisdictional determination proceedings subsumed into main proceeding under § 16 No. 3a RVG
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court ordered the dismissal of the jurisdictional determination proceedings without a cost order, effectively resolving the dispute as the parties unanimously declared the matter moot. The case involved a procedural challenge under § 53 VwGO regarding the determination of the competent court for an underlying main proceeding. The court held that no separate cost assessment is required because jurisdictional determination proceedings are exempt from court fees and, pursuant to § 16 No. 3a RVG (effective since August 1, 2013), constitute the same subject matter as the underlying main proceeding; consequently, the costs of the jurisdictional procedure, including attorney's fees, are subsumed into the costs of the main proceeding even when the jurisdictional process is discontinued without a final determination of the competent court.

Februar 1987 - I ARZ 703/86 - NJW-RR 1987, 757 und vom 7. Januar 2014 - X AZR 578/13 - NJW-RR 2014, 248 Rn. 19; ebenso zu § 53 VwGO Kraft, in: Eyermann, VwGO, 16. Aufl. 2022, § 53 Rn. 18), überzeugt jedenfalls nicht mehr, seitdem zum 1. August 2013 die Vorschrift des § 16 Nr. 3a RVG in Kraft getreten ist (Art. 8 Abs. 1 Nr. 7 Buchst. b und Art. 50 des Zweiten Gesetzes zur Modernisierung des Kostenrechts vom 23. Juli 2013, BGBl. I S. 2586; kritisch bereits zuvor C. Herz, Die gerichtliche Zuständigkeitsbestimmung, 1990, S. 154 f.). Juni 2019 - 1 AR 12/18 - NJW-RR 2019, 957).
