Whether the InVeKoSV deadline for confirming permanent grassland status acts as a substantive exclusion bar against late-submitted corroborating evidence
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) reversed the lower court’s denial of leave to appeal and ordered that the revision (appeal) be admitted, leaving the costs of the complaint procedure to be determined by the final merits judgment while provisionally setting the amount in dispute at 5,000 €. The dispute concerned a preliminary procedure to determine the classification of specific agricultural land as permanent grassland under the InVeKoSV, specifically challenging the application of a transitional provision that requires additional declarations and documents for land designated in the 2018 application year. The BVerwG held that the appeal was necessary to clarify the fundamental legal question of whether the deadline stipulated in § 10a Abs. 1 InVeKoSV constitutes a substantive exclusion period that bars the consideration of late-submitted evidence intended to concretize or supplement timely provided information under § 10a Abs. 2 Satz 1 Nr. 2 InVeKoSV.

[GRUENDE]
