Normenkontrolle against spatial planning plans: admissibility of challenging inner-area usage objectives by landowners
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted the applicant's complaint by vacating the appellate court's order refusing leave to appeal and admitting the appeal to the Federal Court of Justice. The dispute concerns a norm control action (*Normenkontrolle*) brought by a landowner against a spatial planning instrument (*Raumordnungsplan*), specifically challenging whether such a plan can be attacked when it sets spatial planning objectives affecting the use of the owner's property located in an inner development area. The admission of the appeal is based on the provision for significant legal questions under § 132(2) No. 1 VwGO, as the case involves the pivotal legal question of whether a property owner in an inner area may contest a spatial planning plan through norm control when the plan's objectives directly impact the use of their land.
