Spatial planning protection of local retail supply in non-central towns under the impairment prohibition
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court allowed the appeal to quash the refusal of the prior non-acceptance decision, thereby granting the applicant the right to proceed with the appeal on the merits, while reserving the final cost allocation for the subsequent decision and provisionally fixing the amount in dispute at €60,000. The case arises from a planning law dispute concerning whether spatial planning objectives may protect local retail supply in non-central towns from impairments, challenging the lower administrative court’s refusal to hear the matter on the merits. The decision is based on § 132(2) No. 1 VwGO, which permits the admission of an appeal where the legal matter is capable of contributing to the clarification of a significant legal question, specifically addressing the interaction between spatial planning goals and the prohibition of impairments in favor of local commercial supply, with the provisional value set pursuant to §§ 47(1) sentence 1, 52(1), and 63(1) sentence 1 GKG.
