The Federal Administrative Court granted legal aid and appointed counsel for the plaintiff, overturned the Higher Administrative Court of Berlin-Brandenburg’s order denying leave to appeal, and admitted the revision, thereby allowing the case to proceed to the Federal Court. The dispute concerns a challenge to an immigration authority’s decision regarding refugee status, specifically focusing on the assessment of claims based on the refusal to perform military service. The court determined that the revision was admissible due to the fundamental significance of the legal issues, which require clarification on the requirements for establishing a "strong presumption" of a link between such refusal and a ground for persecution, as well as the rebuttal of that presumption within judicial fact-finding. The decision rests on § 132 Abs. 2 Nr. 1 VwGO and interprets Art. 9 Abs. 2 e and Art. 10 of Directive 2011/95/EU in conjunction with § 3a and § 3b of the German Asylum Act (AsylG), referencing the Court of Justice of the European Union’s judgment in Case C-238/19.
