Legislator-Zusammenfassung

The Federal Administrative Court reversed the lower court’s refusal and admitted the plaintiff's revision, ordering that the appeal proceed before the full bench. The dispute concerned the legality of an animal welfare order issued under German administrative law, specifically challenging which point in time determines the lawfulness of a regulatory measure that reiterates requirements already set out in the Animal Welfare Keeping and Care Regulation for livestock. The decisive legal basis for admitting the revision was the requirement to clarify a question of fundamental importance under § 132 Abs. 2 Nr. 1 VwGO, involving the interplay between the Animal Protection Act (§ 16a Abs. 1 S. 1, 2 Nr. 1; § 2 Nr. 1 TierSchG) and the Animal Welfare Keeping and Care Regulation.
