Decisive point in time for minor status in family reunification to subsidiary protection beneficiaries under § 36a AufenthG
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted legal aid to the plaintiff and admitted the appeal on points of law by setting aside the Oberverwaltungsgericht Berlin-Brandenburg’s decision not to admit the revision. The dispute concerns family reunification to a parent with subsidiary protection, specifically challenging the legal question of the decisive point in time for establishing the child’s minor status at the time of the application. The court found the appeal admissible and well-founded based on the fundamental significance of the issue, which requires clarification under § 36a of the Residence Act (§ 36a AufenthG) in conjunction with the temporal application and suspension of the regulation under § 104(13) of the former Residence Act.
