The Federal Administrative Court (BVerwG) overturned the Higher Administrative Court of North Rhine-Westphalia's refusal to grant leave for appeal and admitted the revision, thereby allowing the case to proceed to the Federal Court on the merits. The dispute concerns the classification of a product as a "presentation medicine" where the respondent challenged the application of health-related mandatory labeling requirements for a product declared as a food for special medical purposes (dietary food for the management of a specific medical condition). The court determined that the legal issue regarding whether such health-related mandatory specifications are fundamentally incapable of justifying the classification as a presentation medicine—even if the product likely does not meet the technical prerequisites for being a balanced diet—has fundamental significance, thereby satisfying the statutory requirement for admission to the federal court. The decision is based on § 132 Abs. 2 Nr. 1 VwGO (German Code of Administrative Court Procedure) for granting leave for appeal and § 63 Abs. 1, § 47 Abs. 1, and § 52 Abs. 1 GKG (Court Costs Act) for the preliminary determination of the amount in dispute at €50,000.
