Eligibility of agricultural parcels below minimum size thresholds for payment claims under EU Regulations 639/2014 and 1306/2013
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court quashed the lower court’s decision refusing leave to appeal and granted admission of the revision, thereby reversing the procedural status of the prior judgment and allowing the case to proceed to the Senate for merits review. The dispute concerned agricultural subsidies, specifically whether a payment claim must be assigned for a land parcel listed in a collective application that does not meet the minimum size threshold for individual subsidy applications. The decisive legal basis involved the interpretation of Article 15(1) of Commission Regulation (EU) No 639/2014 and Article 2(1)(2)(23)(a) of Commission Regulation (EU) No 640/2014, read in conjunction with Article 72(1)(2) of Regulation (EU) No 1306/2013, focusing on the requirements for minimum parcel size in the context of payment claim allocation.
