Sufficiency of B1 German language proficiency as a "declaration by other means" to revoke non-German ethnicity entries under the Nationality Act
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) overturned the Higher Administrative Court’s refusal to admit an appeal and ordered that the case be remanded for further review, effectively ruling in favor of the complainant. The dispute concerned an individual’s attempt to amend a recorded non-German ethnicity (Volkstum) entry in their civil registry, specifically whether demonstrating German language proficiency at the B1 level of the Common European Framework of Reference for Languages constitutes a valid "declaration by other means" under the relevant nationality statutes to revoke previous statements of affiliation. The BVerwG held that the issue possessed fundamental legal significance, requiring clarification on whether such language certification satisfies the statutory requirements for modifying ethnic designations, and accordingly ordered the admission of the revision proceeding under § 132 Abs. 2 Nr. 1 VwGO.
