The Federal Administrative Court (BVerwG) allowed the appeal and referred the matter to the higher regional administrative court, granting the appellant's request for leave to appeal (Revisionszulassung). The dispute concerned a norm control action under § 47(1)(1) VwGO against an amended zoning plan (Bebauungsplan), specifically raising the question of whether the deadline for pleading the cause of action prescribed by § 6 UmwRG applies when the application was filed after the entry into force of the Act adapting the Environmental Legal Remedies Act (Umwelt-Rechtsbehelfsgesetz) of May 29, 2017. The court based its decision on § 132(2)(1) VwGO, finding that the revision contributes to clarifying this unresolved legal issue, and set the provisional dispute value for the revision proceedings pursuant to § 47(1) sentence 1, § 52(1), and § 63(1) sentence 1 GKG.

Revisionszulassung; Anwendbarkeit von § 6 UmwRG in Normenkontrollverfahren gegen Bebauungspläne

[GRUENDE]

I S. 1298) gestellt worden ist.

Die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 47 Abs. 1 Satz 1, § 52 Abs. 1 und § 63 Abs. 1 Satz 1 GKG.
