Legislator-Zusammenfassung

KI-generiert

The Federal Administrative Court admitted the plaintiff's appeal to the revision court, allowing the case to proceed on the basis of § 132 Abs. 2 Nr. 1 VwGO, while tentatively fixing the amount in dispute for the revision proceedings under §§ 47 Abs. 1, 53 Abs. 3 GKG. The dispute concerns the appropriateness of contractual services in an urban planning agreement, specifically challenging the arrangement where a private individual acquired land from a third party and undertook the urban redevelopment on its own cost, while the municipality received compensation payments from the third party pursuant to § 154 Abs. 1 BauGB. The decisive legal issue for the upcoming revision is determining the prerequisites under which such agreed services are considered appropriate within the meaning of § 11 Abs. 2 Satz 1 BauGB in light of the totality of circumstances, including the interplay between private investment and municipal compensation claims.

Die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 47 Abs. 1, § 53 Abs. 3 Satz 1 GKG.
