Police officer tattoo authorization: statutory specificity of civil servant appearance regulations
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) allowed an appeal to the higher court, finding the plaintiff's challenge to the lower court's refusal to grant leave to appeal was well-founded, thereby permitting the case to proceed to the Federal Administrative Court on the merits. The dispute concerns a police officer's challenge to the denial of authorization for a tattoo, specifically addressing whether the statutory empowerment regulating the permissible extent of tattoos for civil servants is sufficiently specific. The court admitted the appeal on grounds of fundamental significance pursuant to § 132(2) No. 1 VwGO, citing the need for further clarification of the legal requirements for specific statutory authorization based on existing case law, while also determining the relevant dispute values under the Legal Fees Act (GKG).
