The Federal Administrative Court admitted the revision appeal of the associated party under § 132(2) No. 1 VwGO, thereby overturning the lower court's dismissal and setting the provisional value in dispute for the appellate phase. The dispute concerns a conflict between two mutually interfering wind energy installations, specifically regarding whether one turbine must defer to the other's impact on turbulence, arising from a challenge to an administrative decision where one facility underwent a pre-permit procedure and the other a full licensing procedure. The decisive legal issue centers on the application of the duty of consideration and the priority principle in balancing competing wind energy projects, requiring clarification of which installation must accommodate the other's operational impacts.
