The Federal Administrative Court dismissed the defendant's complaint against the non-admission of revision as inadmissible, leaving the lower court's decision in force. The case involved a disciplinary proceeding where a civil servant, previously convicted of perjury and attempted obstruction of justice, had been dismissed from service by the administrative court and that dismissal was upheld on appeal by the higher administrative court. The defendant challenged the refusal to admit a further appeal to the Federal Administrative Court, arguing for its admissibility. The court held that the complaint was not permissible because the Saxony-Anhalt Disciplinary Law does not allow for a revision against judgments of the higher administrative court in disciplinary matters, and the supplementary reference to the Code of Administrative Procedure does not create access to the federal level. Costs were awarded against the defendant under specific provisions of the Disciplinary Law and the Code of Administrative Procedure.
