The Federal Administrative Court granted the applicant's leave to appeal, thereby allowing the case to proceed to the revision instance based on the significant legal question presented. The dispute concerned the admissibility of a norm control action (Normenkontrolle) challenging a statutory provision, specifically where the applicant had failed to file objections during the public exhibition of a draft zoning plan as required by § 3 Abs. 2 BauGB, and where the legal basis for admissibility (§ 47 Abs. 2a VwGO) was repealed by a 2017 amendment to the Environmental Legal Remedies Act effective June 2, 2017, after the application was filed but before the court's decision. The court identified the decisive legal issue as determining whether a norm control application filed prior to the legislative repeal is inadmissible when the reviewing court decides on the matter only after the repeal takes effect, citing the lack of uniform case law on this procedural temporal question as the basis for § 132 Abs. 2 Nr. 1 VwGO.

Revisionszulassung; Unzulässigkeit einer Normenkontrolle nach Rechtsänderung; Präklusion

[GRUENDE]
