Legislator-Zusammenfassung

The Federal Administrative Court (5th Senate) granted leave to appeal for the applicant’s legal complaint, ruling that the case raises a question of fundamental legal significance. The dispute concerns a challenge to a change in administrative practice by a department head, who switched from internally to externally advertising vacant service positions; the specific issue is whether this shift in posting method constitutes a decision subject to the joint-works-council’s co-determination rights under § 75(3) No. 14 of the Federal Personnel Representation Act (BPersVG). The Court found the complaint admissible under § 83(2) BPersVG in conjunction with § 72(2) No. 1 and § 92(1) sentence 2 of the German Labor Court Act (ArbGG), necessitating further review by the Senate to clarify the scope of the co-determination statute regarding the external vs. internal distinction in job advertising.
