The Federal Administrative Court (BVerwG) allowed the appeal against the admission of revision, finding the legal issue to be of fundamental significance, thereby permitting the appellant to proceed to the Revisionsverfahren. The dispute concerned the legality of a Nebenbestimmung (side condition) attached to a gambling law license, specifically a condition securing the exclusion of underage players, with the core question being whether such a condition is independently challengeable and susceptible to isolated cancellation. The court identified the decisive legal issues under § 132 Abs. 2 Nr. 1 VwGO, focusing on whether a defect affecting the entire administrative act precludes the isolated revocation of a validly independent side condition, and clarified the applicable procedural norms for litigation costs under § 47, § 52, and § 63 GKG.

Revisionszulassung; glücksspielrechtliche Erlaubnis; Nebenbestimmung

[GRUENDE]
