Compatibility of statutory pharmaceutical price binding with prohibition of nationality discrimination under Article 3(1) of the Basic Law
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted the plaintiff's complaint, allowing the appeal on the ground that the case possesses fundamental significance, and set a provisional amount in dispute for the revision proceedings. The dispute concerns the validity of the statutory price binding for pharmaceuticals applicable to domestic pharmacies, specifically challenging whether this regulation violates the prohibition of discrimination against German nationals in the cross-border provision of healthcare services, as established by the European Court of Justice. The decisive legal question involves the compatibility of the domestic price binding mechanism under § 78 Abs. 1 and 2 of the German Medicines Act (AMG) and § 3 of the Pharmaceuticals Pricing Regulation (AMPreisV) with Article 12(1) of the EU Charter of Fundamental Rights and Article 3(1) of the German Basic Law, following the CJEU's judgment in the Deutsche Parkinson Vereinigung case.
