Liability of recognized conscientious objectors for reimbursement of specialized military training costs following early termination of service
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted the plaintiff's complaint and permitted an appeal to the revising instance, finding the appeal justified due to the fundamental significance of the legal question involved. The dispute concerns the reimbursement of training costs to the Federal Armed Forces by a recognized conscientious objector whose professional soldier service was terminated early, specifically regarding the extent to which such individuals are liable for costs associated with specialized training as an air traffic control officer. The decision relies on Section 132(2) No. 1 of the Administrative Court Procedure Act (VwGO) to allow the revising court to further clarify the scope of liability for training cost recovery under the Federal Pay Structure Act (SG) in cases involving early termination of service for recognized conscientious objectors.
