Applicability of General Railway Act provisions to tram line extensions with concurrent freight traffic
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted permission to file an appeal on points of law (Revisionszulassung) in a preliminary ruling, leaving the lower court's judgment otherwise in force pending the substantive appeal. The dispute concerned a planning approval procedure for the extension of a tram line that also involved the continued operation of a small volume of freight traffic on dedicated railway infrastructure. The core legal issue is whether the specific provisions of the General Railway Act (AEG) §§ 18 ff. (relating to the dedication of railway lines) apply to such mixed-use projects, a question the court deemed to have fundamental significance under § 132 Abs. 2 Nr. 1 VwGO. The court also set a preliminary fee-bearing amount for the appeal under §§ 47, 63 GKG.

Revisionszulassung; Anwendbarkeit der §§ 18 ff. AEG 1994; Verlängerung einer Straßenbahnlinie bei stattfindendem Güterverkehr
[GRUENDE]
