Jurisdiction for post-judgment determination of necessity for legal representation in administrative pre-proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) ordered the referral of the case to the administrative court of first instance for the entry of a subsequent decision on the necessity of appointing a representative for the pre-proceedings, ruling that this specific determination falls within the jurisdiction of the court competent for cost assessment. The dispute arose after the final judgment was issued, when the plaintiffs filed a post-judgment application to have such representation declared necessary under § 162(2) sentence 2 of the Administrative Court Procedure Act (VwGO). The court held that applications submitted after the completion of proceedings must be decided by a subsequent order by the court responsible for costs, which is the first-instance court under § 164 VwGO, thereby mandating a transfer of the matter to that lower court under § 83(1) VwGO in conjunction with § 17a(2) sentence 1 of the Courts Constitution Act (GVG); the decision itself is final and unappealable.
