Cost allocation for withdrawn legal appeal in Wehrbeschwerdeordnung proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) ordered the applicant-petitioner to bear the costs of the legal appeal proceedings following their withdrawal of the legal appeal, thereby finalizing the procedural outcome with the lower court's decision remaining in force. The case involved a military service dispute under the Military Complaint Ordinance (WBO), specifically addressing the allocation of litigation costs in a court-ordered application procedure and subsequent legal appeal (Rechtsbeschwerde) before a garrison court and the Federal Administrative Court. The decisive legal basis was the joint application of § 23a Abs. 2 Satz 1 WBO in conjunction with § 155 Abs. 2 Alternative 3 VwGO, establishing that the applicant is liable for costs when withdrawing a legal appeal, as the WBO lacks specific cost provisions for losing applicants in second-instance proceedings that mimic administrative revision structures.

Rechtsbeschwerdeverfahren; Kostenlast bei Rücknahme
[LEITSATZ]
§ 92 Abs. 3 Satz 1 VwGO einzustellen.
Die Kostenentscheidung folgt aus § 23a Abs. 2 Satz 1 WBO i.V.m. § 155 Abs. 2 Alt. 3 VwGO.

Beschluss vom 25.
