Timeliness of NS reparation claims: requirement to conclusively concretize asset before statutory exclusion period expires
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted the defendant’s complaint and ordered the admission of a revision appeal, resolving the preliminary dispute in favor of the defendant who challenged the lower instance's refusal to allow the appeal. The case concerns a claim for compensation under the Federal Act on Reparation for Victims of National Socialism, where the core legal dispute focused on whether the asset to be compensated must be conclusively concretized by the expiration of the statutory exclusion periods specified in § 1(1a). The court held that a subsequent divergence of judgments existed, as its earlier ruling in a related case had affirmed this requirement, thereby justifying the admission of revision under § 132(2)(1) and (2) VwGO due to both the subsequent conflicting decision and the fundamental significance of the legal question regarding the timeliness of claims under § 1(1a) NS-VEntschG.

[GRUENDE]
11) bejaht.
Die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 47 Abs. 1, § 52 Abs. 1 und § 63 Abs. 1 Satz 1 GKG.
