Legislator-Zusammenfassung

KI-generiert

The Federal Administrative Court granted leave to appeal, allowing the revisions of the defendant and an intervening party to proceed on grounds of the case's fundamental legal significance. The dispute concerns the scope of a location-based preliminary Environmental Impact Assessment (UVP), specifically whether and to what extent species protection interests must be considered during this screening phase under the German Environmental Impact Assessment Act. This decision allows the final court to clarify the legal requirements for factoring in biological conservation goals within the preliminary review process, in light of the legislation modernizing environmental assessment law enacted in July 2017. The key legal norms at issue include § 132 Abs. 2 Nr. 1 VwGO regarding the criteria for granting leave to appeal on questions of fundamental significance, and the provisions of the Umweltverträglichkeitsprüfungsgesetz (UVPG) governing the preliminary examination procedure.
