Legislator-Zusammenfassung

The Federal Administrative Court granted the appeals of the defendant and the intervener, admitting the revision on grounds of the case's fundamental significance, and set the value in dispute, thereby overturning the lower instance's refusal and allowing the case to proceed to the Federal Administrative Court for a decision on the merits. The dispute concerns an environmental impact assessment (EIA) pre-screening procedure for a site-specific project, where the core issue is whether and to what extent species protection interests must be considered during the preliminary assessment under the Federal EIA Act, particularly in light of the legislative modernization effective July 20, 2017. The decisive legal basis is § 132 Abs. 2 Nr. 1 VwGO, which mandates the admission of revision when a case involves a legal question of fundamental significance that requires clarification by the higher court.
