The Federal Administrative Court granted permission for appeal on grounds of fundamental legal significance, upholding the defendant's and intervenors' complaints and thereby allowing the case to proceed to a full revision hearing. The dispute concerns a challenge to a preliminary environmental impact assessment (EIA) decision under the EIA Act, specifically questioning whether and to what extent species protection interests must be taken into account during the site-specific preliminary screening stage. The decisive legal basis is § 132 Abs. 2 Nr. 1 VwGO, which permits revision if the matter is of fundamental legal importance, particularly in light of the 2017 amendment to the EIA Act which modified the requirements for preliminary assessments involving biodiversity and species protection.
