Legislator-Zusammenfassung

KI-generiert

The Federal Administrative Court granted the defendant's and intervenors' appeals and permitted an appeal on points of law, finding that the appellant prevailed in the interlocutory stage by establishing the general significance of the legal issue for admission under § 132 Abs. 2 Nr. 1 VwGO. The case concerns a dispute regarding the consideration of species protection interests in the site-specific preliminary review (Scoping Procedure) under the Environmental Impact Assessment Act (UVPG). The decisive legal basis involves the interpretation of the UVPG as amended by the Modernization Act of July 20, 2017, specifically addressing whether and to what extent species protection concerns must be evaluated during the initial site-specific screening phase of environmental impact assessment proceedings.
