Legislator-Zusammenfassung

KI-generiert

The Federal Administrative Court (BVerwG) granted leave to appeal in a revision proceeding, ruling that the defendant's and the joined party's appeals were well-founded. The dispute concerns the scope of a site-specific preliminary impact assessment (UVP-Vorprüfung) under the Environmental Impact Assessment Act, specifically whether and to what extent species protection interests must be considered during this screening phase. The court ordered that the case be reviewed on its merits because the question presents fundamental significance, particularly in light of the 2017 amendments to the EIA legal framework, thereby leaving the lower instance judgment subject to further judicial review by the higher court. The decision is based on § 132 (2) No. 1 of the Code of Administrative Court Procedure (VwGO) regarding the criteria for allowing a revision appeal.

[GRUENDE]

Juli 2017 (BGBl.
