Admissibility of marketing soy drinks with algal calcium as organic products under EU organic regulations
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted leave to appeal and ruled in favor of the plaintiff, determining that the case possesses fundamental legal significance requiring clarification on whether specific organic regulations prohibit the marketing of soy drinks containing calcium derived from the algae *Lithothamnium calcareum* as organic products. The dispute concerns the permissibility of placing such beverages on the market under the European organic farming framework, challenging the interpretation of labeling and additive rules. The decisive legal basis involves Article 23(4)(a) and Article 19(2)(c) of Regulation (EC) No 834/2007, in conjunction with Article 28 and Annex IX No. 1.3 of Implementing Regulation (EC) No 889/2008, with the provisional amount in dispute set according to the German Court Fees Act.
