Legislator-Zusammenfassung

The Federal Administrative Court (BVerwG) admitted an appeal on points of law, ruling in favor of the appealing party, without deciding the merits of the case at this stage. The dispute concerns the legal effect of a works committee (Einigungsstelle) decision regarding a specific personnel measure—the temporary assignment of employees—under the personnel rights act for state government employees. The court identified an open question of fundamental significance regarding the validity and binding nature of such a works committee decision when the affected employee does not exercise sovereign or public authority functions, thereby leaving the lower instances' outcomes pending further review. The decisive legal basis involves the interplay between the state personnel rights act, specifically the provisions on personnel measures and works committee competence, and the procedural rules governing appeals in labor and personnel disputes.
