Damages for failed civil service promotion: scope of § 839 Abs. 3 BGB's prior-remedy requirement for informal inquiries
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court admitted an appeal on points of law, granting the civil servant-plaintiff a procedural victory by permitting further review of the lower court’s rejection of his claim; the dispute concerned a damages claim for a failed promotion, specifically challenging whether informal legal remedies and simple inquiries constitute the mandatory exhaustion of primary legal protection required before asserting damages. The decisive legal basis includes § 132 Abs. 2 Nr. 1 VwGO for the admission of the revision on grounds of general legal significance, and § 839 Abs. 3 BGB, which mandates the prior use of legal remedies (*Rechtsmittel*) to limit state liability, with the court identifying the unresolved question of whether formless legal acts or mere inquiries qualify as such remedies under the statute.
