Legislator-Zusammenfassung

KI-generiert

The Federal Administrative Court granted the defendant's petition for leave to appeal, permitting a revision proceeding to proceed. The case involves a disciplinary matter challenging the applicability of the principle of "gradual escalation of disciplinary measures" to a civil servant with no prior disciplinary record, where multiple service violations spanning from January 2013 to May 2014 individually did not justify the maximum sanction but cumulatively raised questions of whether the employer's or public confidence had been lost. The decisive legal issue concerns the scope of § 13 Abs. 1 BDG and § 13 Abs. 2 LDG NRW, specifically whether the gradual escalation doctrine applies to non-previously disciplined civil servants in cases of temporally distributed cumulative breaches.
