The Federal Administrative Court (BVerwG) granted leave to appeal for the plaintiff in a dispute concerning the appropriate monetary compensation for restrictions on mining property rights imposed by a nature conservation area regulation. The court found the complaint against the lower court's denial of admission to be well-founded, ordering that the case proceed to the full revision proceedings on the merits, where the core legal question is under what federal law conditions such conservation-based limitations to mining ownership necessitate adequate financial compensation. The decisive legal basis for this procedural decision is § 132(2)(1) of the Administrative Court Procedure Act (VwGO), which permits admission where the case contributes to the further clarification of a significant legal issue, specifically the interplay between mining property rights and statutory nature conservation protections.
