Forfeiture of Civil Servant Damages Claims for Delayed Promotion: Time and Circumstance Requirements
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court admitted the appeal for further review, granting the plaintiff's challenge to the lower court's refusal to admit the appeal, on grounds of fundamental legal significance and divergence from the Koblenz Higher Administrative Court. The dispute concerns the requirements for the forfeiture (verwirkung) of a civil servant's claim for damages due to delayed or omitted promotion, specifically focusing on the applicable time and circumstance elements. The decision establishes the legal basis for the subsequent merits review, citing § 132(2) No. 1 and No. 2 VwGO in conjunction with § 127 No. 1 BRRG, and sets the preliminary dispute value according to § 63(1) and § 47(1), (3) GKG.
