The Administrative Court of Appeal (BVerwG) granted the appeal and authorized the filing of a revision complaint, finding the case to be of fundamental significance under § 132 Abs. 2 Nr. 1 VwGO. The dispute concerns the calculation of the average weekly working hours under § 7 Abs. 8 Satz 1 of the Working Time Act (ArbZG), specifically whether vacation days exceeding the statutory minimum and statutory public holidays that do not fall on a Sunday must be included as compensatory days in this calculation. The Court determined that the revision proceeding offers the opportunity to clarify this unresolved legal question, while setting the preliminary amount in dispute for the revision phase based on § 47 Abs. 1, § 52 Abs. 1, and § 63 Abs. 1 Satz 1 GKG.
