Unification Treaty jurisdiction for municipal administrative real estate: territorial location versus functional assignment to another administrative body
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted permission to appeal (Revisionszulassung) in favor of the third-party co-respondent, finding that the lower court's decision was challenged on grounds of fundamental significance. The dispute concerns the determination of the responsible administrative body for the allocation of real estate assets classified as municipal administrative assets (Verwaltungsvermögen) under the Unification Treaty (Einigungsvertrag), with the core issue being whether jurisdiction is determined solely by the physical location of the assets or must also consider the purpose of the assets if they serve the tasks of a different, non-territorial administrative body. The court identified the legal question of fundamental significance as whether Article 21, paragraphs 1 and 2 of the Unification Treaty requires exclusive consideration of territorial competence or allows for the allocation based on functional administrative responsibility, a ruling that would also clarify the prerequisites for district-level (Landkreis) competence versus municipal competence under the Basic Law.
