Unlawfulness of deportation orders: scope of § 60 Abs. 5/7 AufenthG determinations in inadmissible asylum cases
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court dismissed the defendant's appeal and granted leave to file a revision, allowing the case to proceed due to a subsequent divergence in case law. The dispute concerned whether a deportation order or threat contained in a decision rejecting an asylum application as inadmissible is unlawfully issued if the immigration authority fails to explicitly determine the presence of domestic deportation bans. The court held that the prior instance's view—that such an omission renders the measure unlawful—contradicted a recently established legal principle by the same senate, which mandates that these determinations are limited to the target state of deportation rather than the country of origin and that their absence in the specific text of the inadmissibility decision does not automatically invalidate the deportation measure. Consequently, the court ordered that the revision must be permitted to resolve this conflict, rendering the defendant's additional arguments moot for the purpose of this procedural decision.

Revisionszulassung; nachträgliche Divergenz; Rechtswidrigkeit einer Abschiebungsanordnung bzw. -androhung
[GRUENDE] 1
