Permissibility of 4% interest on deferred student loan repayments during a prolonged low-interest rate phase
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court admitted the revision appeal, leaving the lower instance outcome pending pending a higher-level hearing on the substantive issue. The dispute concerns whether a 4% interest rate is permissible for the deferral of repayment claims for student financial aid, a matter characterized by the court as lacking uniform supreme court jurisprudence and subject to conflicting rulings among regional courts. The decision hinges on the assessment of the historical low-interest rate environment and applies § 63 Abs. 1 Satz 1 in conjunction with § 52 Abs. 3 Satz 1 of the Court Fees Act (GKG) to provisionally determine the value of the subject matter for the revision proceedings.

OVG Weimar, Urteil vom 12. November 2015 - 2 KO 171/15 - juris Rn. 33 einerseits, OVG Münster, Urteil vom 24. Februar 2016 - 1 A 335/14 - juris Rn. 75 ff. andererseits).
§ 52 Abs. 3 Satz 1 GKG.
