The Federal Administrative Court (BVerwG) granted leave to appeal the defendant's complaint, overturning the lower court's decision not to admit the revision, thereby allowing the case to proceed to the appellate stage where the substantive merits will be decided. The dispute concerned a claim for compensation under the Act on the Removal of the Consequences of National Socialist Persecution (VermG), specifically regarding shares in a stock corporation sold in 1942 to settle the Jewish Property Levy; the plaintiff had claimed "fractional restitution" (Bruchteilsrestitution) for these assets, which the administrative authority rejected and the lower administrative court had reversed by ordering the defendant to acknowledge the plaintiff's entitlement to the nominal value of the shares. The BVerwG found the revision admissible under § 132 Abs. 2 Nr. 1 VwGO due to the fundamental legal question of whether a claim for fractional restitution of assets lost to persecution in companies located outside the territory of accession is contingent upon restitution occurring under a different law enacted after May 8, 1945, as stipulated in § 3 Abs. 1 Satz 4 Halbs. 1 and 2 VermG.

Revisionszulassung; Voraussetzungen der Bruchteilsrestitution

[GRUENDE]

§ 3 Abs. 1 Satz 4 Halbs. 1 VermG) erfolgt ist.

Die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 47 Abs. 1, § 52 Abs. 1, § 63 Abs. 1 Satz 1 GKG.
