Legislator-Zusammenfassung

The Federal Administrative Court granted leave to appeal, ruling in favor of the complainant and finding that the prior lower court's refusal was erroneous; consequently, the revision proceedings are now admissible. The case involves a dispute over urban planning law, specifically challenging the approval of a redevelopment statute and the legal significance of a cost and financing overview regarding the achievability of redevelopment goals. The decisive legal basis is the fundamental significance of the issue for the interpretation of § 149 of the German Building Code (BauGB) within the framework of §§ 136 and 142 BauGB, as assessed under §§ 132 and 133 of the Administrative Court Procedure Act (VwGO), which permits revision to clarify the land-law relevance of financing documents in such statutory contexts.

Die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 47 Abs. 1 Satz 1, § 52 Abs. 1 und § 63 Abs. 1 Satz 1 GKG.
