Legislator-Zusammenfassung

The Federal Administrative Court allowed an appeal on points of law, granting the plaintiffs' request and determining that the case has fundamental significance, thereby enabling the Revisionsverfahren to proceed. The dispute concerned the interpretation of the German Federal Nature Conservation Act, specifically whether municipalities are obligated to permit free public access to all areas of their maritime beaches, including sections enclosed and operated as commercial beach baths by a municipal entity under a lease agreement with the federal state. The decisive legal question identified for the appellate review is whether § 62 BNatSchG in conjunction with Article 2(1) of the Basic Law mandates an interpretation of § 59(1) BNatSchG that compels municipalities to allow unenclosed public access to all beach areas, even those dedicated to commercial use by a municipal subsidiary.

Revisionszulassung; unentgeltliches Betreten von kommerziell genutzten Strandflächen

[GRUENDE]

Juli 2009 (BGBl. I S. 2542), zuletzt geändert durch Art. 19 des Gesetzes vom 13. Oktober 2016 (BGBl. I S. 2258) i.V.m.
