Binding effect of foreign criminal judgments in German disciplinary proceedings under § 57 BDG
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) allowed the appeal for lack of legal clarity, effectively ruling that the plaintiff’s argument regarding the preclusive effect of foreign criminal judgments merits further review. The case involves a civil service disciplinary proceeding where a public official contested whether a final criminal judgment issued by a Slovakian court binds the disciplinary court under the Federal Discipline Act (§ 57 BDG), specifically arguing that the judgment results in the consumption of criminal claims under Article 54 of the Schengen Implementation Convention in conjunction with Article 50 of the Charter of Fundamental Rights of the European Union. The decisive legal issue is the scope and nature of the binding effect (*Bindungswirkung*) of foreign criminal convictions in German administrative disciplinary proceedings, which the Court deemed suitable for clarification due to its fundamental significance.

[GRUENDE]
