Validity of a residential zoning plan excluding core uses under § 4(2) BauNVO while permitting general exceptions
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court granted leave to appeal, finding the complaint well-founded and allowing the case to proceed to a full revision hearing. The dispute concerns the validity of a detailed development plan that excluded all residential uses permitted under § 4(2) nos. 2 and 3 of the Building Code (BauNVO) while generally permitting exceptions under § 4(3). The court identified a fundamental legal question of general significance regarding whether such a plan violates the general purpose of a general residential area under § 4 BauNVO by excluding core residential functions, thereby necessitating clarification in the upcoming revision proceedings.
