Legislator-Zusammenfassung

KI-generiert

The Federal Administrative Court permitted the appeal on the merits, finding that the case holds fundamental significance, thereby allowing the appellate review of the arbitration board's decision to proceed. The dispute concerned the statutory limits on the competence of a medical arbitration board (Schiedsstelle) when determining hospital-specific daily fees under the Hospital Remuneration Act. The decisive legal basis for the court's ruling is § 132 Abs. 2 Nr. 1 VwGO, which grants appeal permission due to the need to clarify the legal boundaries imposed by § 13 Abs. 1 Satz 2 and § 14 Abs. 1 Satz 2 in conjunction with § 6 Abs. 1 KHEntgG on the arbitration board's fee-setting authority.
