Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted leave to appeal for the plaintiff, allowing the case to proceed to its revision proceeding, thereby prevailing in the procedural stage. The dispute concerns public service law, specifically the compensation of additional work performed in the form of on-call duty, which must be offset by leisure time, with a focus on obligations fulfilled during overseas service. The decision rests on § 132 Abs. 2 Nr. 1 VwGO, establishing that the legal questions regarding the calculation of equivalent leisure time for foreign on-call service are of fundamental significance, as confirmed by the pendency of related revision proceedings before the same court.
