Effect of health insurance fund closure on insolvency capacity and occupational pension insolvency security contribution liability under BetrAVG
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court (BVerwG) granted leave to appeal, upholding the appellant’s complaint for fundamental significance under § 132(2)(1) VwGO and permitting the revision proceedings to proceed. The dispute concerns the legal consequences of the valid closure of a statutory health insurance fund pursuant to § 153 SGB V, specifically whether such closure extinguishes the fund’s insolvency capacity and, consequently, the obligation to pay the insolvency security contribution established under § 10(1) and § 17(2) of the German Occupational Pension Act (BetrAVG). The court identified two key legal questions for resolution: whether the closure of a health insurance fund eliminates its insolvency susceptibility, thereby terminating the pre-existing Beitragspflicht, and whether the equivalence principle further restricts the personal scope of entities subject to the insolvency security contribution beyond the statutory limitations defined in § 17(2) BetrAVG.

Revisionszulassung; Schließung einer Krankenkasse
[GRUENDE]
Dezember 1974 (BGBl. I S. 3610), zuletzt geändert durch Art. 1 des Gesetzes vom 21. Dezember 2015 (BGBl.
