Standing to challenge ship traffic authorization: subjective property rights under Art. 14 GG versus state navigability declarations
Legislator-Zusammenfassung
KI-generiertThe Federal Administrative Court allowed an appeal to it, granting the complainant's motion and establishing that the case is of fundamental importance for determining standing to challenge the authorization of general ship traffic on a waterway. The dispute concerned the lander-legal declaration of navigability and the resulting permission for general vessel passage, with the core issue being whether such authorization infringes upon the property rights of an owner of land in or adjacent to the waterway. The decisive legal basis involved § 132(2) No. 1 VwGO for the admission of the appeal on grounds of fundamental significance, and the court focused on whether subjective rights derivable from Article 14(1) of the German Basic Law or other federal law exist independently of any third-party protection conferred by state navigability regulations, thereby establishing the plaintiff's standing to sue.
